As required by Section 32-1-207(3)(c), C.R.S. and Section VIII of the Amended and Restated Consolidated Service Plan for Murphy Creek Metropolitan District Nos. 1-4 and Service Plan for Murphy Creek Metropolitan District No. 5, approved by the City of Aurora (the “City”) on August 8, 2016, the following report of the activities of Murphy Creek Metropolitan District No. 5 (the “District”) from January 1, 2025 to December 31, 2025 (the “Report Year”) is hereby submitted.
A. Boundary changes made or proposed to the District’s boundaries as of December 31 of the prior year: The District’s boundaries did not change in 2025.
B. Intergovernmental Agreements entered into or terminated:
The District has entered into or terminated the following agreements:
i. Amended and Restated Intergovernmental Agreement between the City and the Districts, dated August 8, 2016.
ii. District Administrative Services Agreement between Murphy Creek Metropolitan District Nos. 1, 2, 4 and 5, dated April 26, 2017. This agreement was subsequently terminated by virtue of the Partial Termination of District Administrative Services Agreement, dated August 26, 2021. An additional Partial Termination of District Administrative Services Agreement was entered into on April 5, 2022, which terminated the obligations of the District under such Agreement.
iii. Aurora Regional Improvement Authority No. 5 Second Amendment to Establishment Agreement, dated November 15, 2018. The Districts are parties to all subsequent amendments.
C. Access information to obtain a copy of rules and regulations adopted:
The District did not adopt any rules or regulations as of December 31, 2025. In the event the District adopts rules of regulations in the future, such documents may be accessed at the offices of McGeady Becher Cortese Williams P.C., 450 E. 17th Avenue, Suite 400, Denver, CO 80203, (303) 592-4380.
D. Summary of litigation involving the District’s public improvements:
To our knowledge, there is no litigation involving the District’s public improvements.
E. Status of the District’s construction of public improvements:
Construction of the District’s public improvements has begun in accordance with the Service Plan.
F. A list of facilities and improvements construction by the District that have been dedicated to and accepted by the City as of December 31 of the prior year:
As of December 31, 2025, the District had not constructed or acquired any facilities or improvements that were conveyed or dedicated to the City.
G. Final assessed valuation of the District for the Report Year:
$7,787,035.
H. Current year’s budget:

I. Audited financial statements for the Report Year (or application for exemption from audit):
The District’s 2025 Audit is still in progress. A copy of the 2025 Audit will be provided upon completion.
J. Notice of any uncured events of default by the District, which continue beyond a ninety (90) day period, under any debt instrument:
To our knowledge, there are no uncured events of default by the District which continue beyond a ninety (90) day period.
K. Any inability of the District to pay its obligations as they come due, in accordance with the terms of such obligations, which continues beyond a ninety (90) day period:
To our knowledge, the District has been able to pay its obligations as they come due.
